4. Purposes and Legal Basis of the Processing.
4.1 Lawful Basis. We process Your Personal Data in accordance with applicable data protection laws and only where a valid basis exists for such processing. Depending on the circumstances, We may rely on one or more of the following legal grounds:

* All sales via cloud providers (except Exoscale) are generally conducted by VyOS Inc., unless otherwise determined by Us, regardless of Customer location. Sales via Exoscale are generally conducted by VyOS EMEA Operations Limited, unless otherwise determined by Us.
This Privacy Policy does not apply where We process Personal Data as a “data processor” on behalf of Our customers (or as a service provider under CCPA). In such cases, Our customer—who has engaged Us under a data processing agreement—acts as the data controller and is responsible for determining how Your Personal Data is handled. We process that information solely on their behalf and in accordance with their instructions. To learn more about how Our customers handle Your Personal Data, please refer to their respective privacy policies and direct any related inquiries to them.

4.2 Voluntary nature of the processing. Providing Your Personal Data for the above-mentioned purposes is voluntary and not mandatory. However, not providing any of such data may not allow Us to establish and/or continue a contractual relationship with You, or to fulfill Your requests, or to comply with legal obligations to which We are subject.
5. Data Retention Period and Security Measures for Your Personal Data.
5.1 Data Retention. We retain Your Personal Data for as long as Your account remains active, You use Our Services or as necessary to fulfill the purposes for which the data was collected. This includes meeting Our contractual commitments, complying with applicable legal and regulatory obligations, resolving disputes, and enforcing Our rights and agreements. The specific retention period may vary depending on the nature of the data, the context in which it was collected, and relevant statutory or regulatory requirements. When Personal Data is no longer required for these purposes, it will be securely deleted or anonymized in accordance with Our data retention policies.
Personal Data collected by Us will be processed for the time strictly necessary to achieve the purposes referred to above. In particular:
Personal Data needed for the provision of Our Services will be processed as long as it is necessary for providing You with the requested Services, until the Personal Data is required for the legitimate purpose of its collection, or until You stop using the Services; if Your Personal Data is no longer necessary for any such purposes, We will delete such Personal Data from Our systems.
Personal Data needed for the provision of Our newsletter will be processed until You decide to unsubscribe.
Personal Data needed for security and fraud prevention purposes will be kept up to 6 (six) months from the termination of Your account and related Services.
Personal Data needed to be kept under applicable laws (for example, tax laws, accounting laws, etc.) will be retained for the period of time imposed by those laws.
Please note that under certain conditions, You can ask us to delete Your Personal Data please refer to the section on Your legal rights below for further information. We will honor Your deletion request only if the applicable condition(s) are met.
5.2 Security measures. We take all reasonable steps to protect Personal Data provided via Our Site and Services from loss, misuse, and unauthorized access, alteration, disclosure, or destruction. Sub-Processors. You acknowledge and agree that We may engage Sub-Processors and share Your Personal Data with them as necessary to provide the Services, including, without limitation, hosting providers, email service providers, payment processors, and customer support providers. We require such Sub-Processors to provide a level of protection for Your Personal Data consistent with this Privacy Policy, to the extent applicable to the nature of the services provided by the respective Sub-Processor.
Affiliates. We may share Your Personal Data with Our affiliates, which are entities that We control, are controlled by, or are under common control with Us, to provide You with the Services and for internal business purposes.
Business Transfers. In the event of a merger, acquisition, reorganization, or sale of all or a portion of Our assets, We may transfer Your Personal Data as part of the transaction. (b) the processing is unlawful and You oppose the erasure of the Personal Data and request the restriction of its use instead;
(c) We no longer need the Personal Data for the purposes of the processing, but it is required by You for the establishment, exercise, or defense of legal claims; or
(d) You have objected to processing pending verification of whether Our legitimate grounds override Your rights.Right to data portability. Withdrawal of consent. Where the processing of Personal Data is based on Your consent, You have the right to withdraw Your consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal. Consent may be withdrawn by sending an email to privacy@vyos.io. Please note that if You withdraw Your consent, We may not be able to provide You with access to certain specific functionalities of Our Site and Services.
Right to lodge a complaint. You have the right to lodge a complaint with a supervisory authority in the EU country of Your habitual residence, place of work, or place of the alleged infringement if You consider that the processing of Personal Data relating to You infringes applicable data protection laws.
